(a) Section 375.094, Local Government Code, does not apply to the district.(b) The district may exercise the power of eminent domain in accordance with Section 49.222, Water Code.(c) The district may not exercise the power of eminent domain outside the district boundaries to acquire:(1) a site for a water treatment plant, water storage facility, wastewater treatment plant, or wastewater disposal plant;(2) a recreational facility as defined by Section 49.462, Water Code; or(3) a site for a road project.
