(a) The district is a special district created under Section 59, Article XVI, Texas Constitution, with all of the powers granted by this chapter.(b) The district is a governmental unit for the purposes of Chapter 101, Civil Practice and Remedies Code, and operations of the district are considered to be essential governmental functions and not proprietary functions for all purposes, including the application of that chapter.
