(a) Section 375.094, Local Government Code, does not apply to the district.(b) Except as provided by Subsection (c), and subject to the consent of the city by ordinance or resolution, the district may exercise the right of eminent domain in the manner provided by Section 49.222, Water Code. The city may not unreasonably withhold consent under this section.(c) The district may not exercise the power of eminent domain outside the district to acquire a site or easement for:(1) a road project authorized by Section 3926.104; or(2) a recreational facility as defined by Section 49.462, Water Code.
