Texas Legal Code
(a) The district may impose an ad valorem tax on all taxable property in the district to:(1) pay for an improvement project of the types authorized by Section 52(b), Article III, and Section 59, Article XVI, Texas Constitution; or(2) secure the payment of bonds issued for a purpose described by Subdivision (1).(b) The district may not impose an ad valorem tax to pay for an improvement project under this chapter unless:(1) a written petition has been filed with the board requesting an election to approve the imposition of the tax signed by the owners of at least 60 percent of the assessed value of the property in the district as determined from the most recent certified county property tax rolls; and(2) the imposition of the tax is approved by the voters of the district voting at the requested election.(c) The district may not impose an ad valorem tax on a residential property, including a multiunit residential property or a condominium.
