The department shall contract with a private entity to operate a railroad using facilities owned by the department and may not use department employees to operate a railroad. The department may maintain a railroad facility directly or through a private entity. The department may not own rolling stock. Added by Acts 2003, 78th Leg., ch. 1325, Sec. 4.01, eff. June 21, 2003.
