(a) The department shall conduct or approve all environmental evaluations or studies required for the construction, maintenance, or operation of a rail facility.(b) The commission may adopt rules to allocate responsibility for conducting an environmental evaluation or study or preparing environmental documentation among entities involved in the construction, maintenance, or operation of a rail facility under this chapter.
