(a) A board may enter into an exclusive development agreement with a private entity.(b) The exclusive development agreement:(1) at a minimum must provide for the design and construction of a commuter rail facility or system; and(2) may provide for the financing, acquisition, maintenance, or operation of a commuter rail facility or system.(c) The board may adopt rules governing an agreement under this section.
