Texas Legal Code
(a) A license application received by the department is considered signed if a digital signature is transmitted with the application and intended by the applicant to authenticate the license in accordance with Subsection (b).(b) The department may only accept a digital signature used to authenticate a license application under procedures that:(1) comply with any applicable rules of another state agency having jurisdiction over department use or acceptance of a digital signature; and(2) provide for consideration of factors that may affect a digital signature's reliability, including whether a digital signature is:(A) unique to the person using it;(B) capable of independent verification;(C) under the sole control of the person using it; and(D) transmitted in a manner that will make it infeasible to change the data in the communication or digital signature without invalidating the digital signature.
