(a) The department shall dispose of all reclaimed asphalt pavement from a road in the state highway system in the most cost-effective and environmentally sensitive manner the department considers appropriate, giving priority to political subdivisions of this state for the maintenance, development, and construction of public works projects.(b) Disposal of reclaimed asphalt pavement under this section is not subject to:(1) Chapter 2175, Government Code; or(2) the statutory or regulatory authority of the comptroller formerly exercised by the General Services Commission.
