(a) A county or municipality shall acquire, in the manner provided by law, the highway right-of-way that is requested by the department.(b) Chapter 21, Property Code, governs the procedure for an acquisition by eminent domain. Acts 1995, 74th Leg., ch. 165, Sec. 1, eff. Sept. 1, 1995.
