Texas Legal Code
(a) A commissioners court may appoint an operating board if the commissioners court determines that a project under this chapter could be developed, constructed, operated, and managed better and more efficiently by an operating board.(b) Except as provided by Subsections (c) and (d), an operating board has the same authority as the commissioners court, including the power of eminent domain, regarding the development, construction, operation, and management of a project under this chapter.(c) The operating board's authority is subject to the limitations prescribed by the commissioners court.(d) An operating board may not:(1) impose a tax or borrow money; or(2) exercise the authority of the commissioners court under Section 284.071 except as provided by order of the commissioners court.
