A home-rule municipality may:(1) construct a sidewalk;(2) provide for the improvement of a sidewalk or the construction of a curb under an ordinance enforced by a penal provision; or(3) declare a defective sidewalk to be a public nuisance. Acts 1995, 74th Leg., ch. 165, Sec. 1, eff. Sept. 1, 1995.
