§ 366.164

(a) To acquire property necessary or useful in connection with a turnpike project, an authority may enter any real property, water, or premises to make a survey, geotechnical evaluation, sounding, or examination.(b) An entry under Subsection (a) is not:(1) a trespass; or(2) an entry under a pending condemnation proceeding.(c) The authority shall make reimbursements for any actual damages to real property, water, or premises that result from an activity described by Subsection (a).
