Texas Legal Code
Cash security or any balance of the security shall be returned to the depositor or the depositor's personal representative when:(1) evidence satisfactory to the department is filed with the department that there has been:(A) a release of liability;(B) a final adjudication that the person on whose behalf the deposit is made is not liable; or(C) an agreement as described by Section 601.154(d)(3);(2) reasonable evidence is provided to the department after the second anniversary of the date of the collision that no action arising out of the collision is pending and no judgment rendered in such an action is unpaid; or(3) in the case of a deposit of security under Section 601.162(b), reasonable evidence is provided to the department after the second anniversary of the date of the deposit that no action arising out of the collision is pending and no unpaid judgment rendered in such an action is unpaid.
