§ 36.208

In establishing an electric utility's rates, the regulatory authority shall:(1) consider a payment made to a qualifying facility under an agreement certified under Subchapter C, Chapter 35, to be a reasonable and necessary operating expense of the electric utility during the period for which the certification is effective; and(2) allow full, concurrent, and monthly recovery of the amount of the payment.
