Withholding of aid If a supervisory union, school district, or agency fails to meet its legally established obligations toward a child with a disability or the child’s parent, and as a result the Agency of Education incurs costs to meet these obligations beyond those otherwise incurred under this chapter, the Secretary shall withhold the amount of funds incurred from any grants due the supervisory union, school district, or agency under this subchapter.
