Definitions; fees (a) As used in this section:(1) 'Major commercial development' means a commercial development for which the Agency requires the applicant to submit a traffic impact study in support of its application under section 1111 of this chapter. (2) 'Minor commercial development' means a commercial development for which the Agency does not require the applicant to submit a traffic impact study in support of its application under section 1111 of this chapter. (3) 'Residential or agricultural purposes' means accesses serving a single-family home, a duplex residence, or logging or field accesses for agricultural uses only. (4) 'Subsurface stormwater system' means a stormwater system, as defined in 10 V.S.A. § 1264(b)(15), that is beneath the surface.(b) The Secretary shall collect the following fees for each application for the following types of permits issued pursuant to section 1111 of this chapter: (c) Notwithstanding subdivision (b)(3) of this section, the Secretary may waive the collection of the fee for a permit issued pursuant to section 1111 of this chapter for a minor commercial development if the Governor has declared a state of emergency under 20 V.S.A. y may waive the collection of the fee for a permit issued pursuant to section 1111 of this chapter for a minor commercial development if the Governor has declared a state of emergency under 20 V.S.A. chapter 1 and the Secretary has determined that the permit applicant is facing hardship, provided that the permit is applied for during the declared state of emergency or within the six months following the conclusion of the declared state of emergency.
