(a) Once the Department has designated a site as Brownsfield, the Department shall issue institutional controls limiting the uses of the site. These controls must be recorded with the Office of the Lieutenant Governor, Recorder of Deeds as a deed notice, and shall run with the land.\n(b) The Department may impose, approve or be a holder of Environmental Covenants pursuant to 28 V.I.C., chapter 18.
