Whoever—\n(1) being an officer charged with the receipt, safekeeping, or disbursement of public money, neglects or fails to keep and pay over the same in the manner prescribed by law; or\n(2) being a clerk, marshal, or other officer, receives any fine or forfeiture and refuses or neglects to pay over the same according to law—\nshall be fined not more than ten thousand ($10,000) dollars or imprisoned not more than ten (10) years, or both, and shall be disqualified from holding any public office.
