(a) The following three categories of persons who were previously convicted and who were not previously required to register, shall be required to register and the Department of Justice shall establish policies and procedures to ensure that they are subject to the registration and updating requirements of this chapter:\n(1) Sex offenders who are presently incarcerated in the Territory or under the supervision of the Office of Probation and Parole of the Territory, whether for a covered sex offense or other crime,\n(2) Sex offenders already registered or subject to a pre-existing sex offender registration requirement under the Territory's laws, and\n(3) Sex offenders re-entering the Territory's justice system due to conviction for any crime.\n(b) The Department of Justice shall ensure recapture of the sex offenders mentioned in this Section within the following timeframe to be calculated from the date of passage of this chapter:\n(1) For Tier 1 sex offenders, 1 year\n(2) For Tier 2 sex offenders, 180 days, and\n(3) For Tier 3 sex offenders, 90 days\n(c) To ensure the recapture of these sex offenders within the above timeframe, the Virgin Islands Bureau of Corrections and the Office
