(a) The Commissioner may deny, revoke, or suspend a license based upon proof that the health service or facility is:\n(1) guilty of fraud or deceit in procuring or attempting to procure a license to provide the health service;\n(2) guilty of a felonious act;\n(3) incompetent by reason of negligence;\n(4) in violation of professional standards of care; or\n(5) incompetent in the performance of functions or duties. A revoked or suspended license may be reissued after one year. Appeals from actions of the Commissioner may be made to a competent court of law.\n(b) Whoever establishes, conducts, manages, or operates any health facility or health service for the practice of a health profession without a license under this chapter shall be fined not more than $500 for the first offense and not more than $1,000 for each subsequent offense. Each day of a continuing violation after conviction shall be considered a separate offense.
