In a proceeding under this subchapter, the testimony of the two or more qualified physicians licensed or permitted to practice in the Virgin Islands shall be heard, together with such other proper evidence as is presented by either party. After all the evidence is heard, the judge shall submit the matter to the jury upon the following special issues—\n(1) Is the defendant of unsound mind?\n(2) If you answer the foregoing question in the affirmative is it necessary that he should be placed under restraint as a mentally ill person?
