A racetrack operator who has a valid Franchise Agreement shall:\n(1) enforce applicable statutory requirements, including but not limited to this chapter and any regulations promulgated by the Virgin Islands Horse Racing Commission pursuant to its authority under this chapter; and\n(2) in addition to other conditions contained in a franchise agreement, or prescribed by law or required by the Virgin Islands Horse Racing Commission, develop a plan to include the hosting of at least one non-thoroughbred race per race day.
