No amusement ride or attraction shall be operated unless the owner or lessee has filed with the Commissioner an affidavit that the ride or attraction has been inspected by a qualified inspector and that the owner or lessee has a current insurance policy in force in an amount of not less than $50,000 per occurrence or an aggregate of not less than $250,000, insuring the owner or lessee against liability for injury to persons arising out of the use of the amusement ride or attraction. An inspection shall be made and an affidavit accompanied by an inspection form approved by the Commissioner shall be filed prior to the amusement ride or attraction's operation.
