There shall be allowed to the marshal for the food and maintenance of any defendant arrested under the provisions of this chapter two dollars per day, and the plaintiff shall be liable in the first instance for such expense, and if required by the marshal shall pay the same weekly in advance; and such expense so paid shall be added to the disbursements taxed or accruing in the case, and be collected as other disbursements.\nIf the plaintiff fails to pay such expense for three days after a demand of payment, the marshal may discharge the defendant from custody.
