175.38 Enforcement of video gambling law. (1) In this section, 'law enforcement officer' has the meaning given in s. 165.85 (2) (c) but does not include a special agent of the department of revenue.(2) Notwithstanding s. 945.041, no law enforcement officer may investigate violations of or otherwise enforce s. 945.03 (2m) or 945.04 (2m).(3) No law enforcement officer may investigate violations of or otherwise enforce s. 945.05 (1m) unless he or she reasonably believes that the video gambling machine involved may be used in connection with a violation of ch. 945 other than a violation of s. 945.03 (2m) or 945.04 (2m).History: 2003 a. 33.
