Section 25-10-106 - Voluntary Applications for Admission

25-10-106. Voluntary applications for admission. (a) The head of a hospital may admit for treatment any adult who has symptoms of mental illness but who has sufficient insight or capacity to make responsible, voluntary application for admission and who applies for admission. (b) A person who has symptoms of mental illness but because of minority or incompetency is not capable of making a responsible, voluntary application for admission may be admitted for treatment upon application by a parent or guardian if the application: (i) Is accompanied by a statement of an examiner that the person is mentally ill; and (ii) An examiner at the hospital, based on a personal interview, determines that the person is mentally ill.
