26-33-101. Definitions. (a) As used in this chapter: (i) 'Account' means the medical liability compensation account; (ii) 'Board' means the board of directors of the medical liability compensation account; (iii) 'Health care' means any act or treatment performed or furnished, or which should have been performed or furnished, by any physician for, to, or on behalf of a patient during the patient's medical care, treatment or confinement; (iv) 'Insurer' means an authority or an insurance company engaged in writing malpractice liability insurance in this state in accordance with this code; (v) 'Malpractice' means the rendering of or failure to render professional medical services as a result of which the patient has a cause of action against a licensed physician for monetary damages; (vi) 'Physician' means a person licensed by the state board of medicine to provide health care or professional services as a physician.
