Section 27-1-116 - Business Relationship Between Franchisors and Franchisees; Business Relationship Between Franchisors and Employees of Franchisees

27-1-116. Business relationship between franchisors and franchisees; business relationship between franchisors and employees of franchisees. (a) Neither a franchisee nor a franchisee's employee shall be deemed to be an employee of the franchisor for any purpose under this title, unless otherwise agreed to in writing by the franchisor and the franchisee. (b) This section shall not apply to a voluntary agreement entered into between the United States department of labor and a franchisee. (c) As used in this section, 'franchisee' and 'franchisor' have the same definitions as set out in 16 C.F.R. 436.1.
