Section 3-2-110 - Appointment of Department of Health or the Department of Family Services as Guardian

3-2-110. Appointment of department of health or the department of family services as guardian. (a) The department of health or the department of family services may petition any district court in the state to be appointed guardian of a minor who is in its custody. (b) If a department in subsection (a) of this section is not the petitioner in a proceeding to appoint a guardian for a ward in its custody, it shall not be appointed guardian unless given prior notice and opportunity for hearing.
