Section 35-11-204 - Department to Establish Requirements for Applications; Certification

35-11-204. Department to establish requirements for applications; certification. (a) The department shall promulgate rules for permit applications, including standard application forms to be submitted pursuant to the operating permit program. The rules shall: (i) Establish specific criteria for defining a complete permit application, including information which identifies a source, its applicable air pollution control requirements, current compliance status, intended operating regime and emissions levels; (ii) Provide for adequate, streamlined and reasonable procedures for determining when an application is complete and for processing an application; and (iii) Provide for public notice of the application, and opportunity for public comment and public hearings. (b) The application, including any information required to be submitted with the application pursuant to this section shall be signed by a responsible official who shall certify the accuracy of the information. (c) Operating permit applications are not required until after the date that the environmental protection agency has issued approval of the state's permit program, or by November 15, 1995, whichever comes first.
