Section 9-23-107 - Prohibited Acts; Civil Penalty; Initiation of Action

9-23-107. Prohibited acts; civil penalty; initiation of action. (a) No person, including any agency official or employee, shall: (i) In any way be involved in any gratuities, kickbacks, or contingent fees in connection with the selection procedure set forth in this act; (ii) If providing professional services, pay any fee, commission, gift or other consideration contingent upon the award of a contract for professional services pursuant to this act. (b) Any person violating subsection (a) of this section or W.S. 9-23-106 is liable for a penalty not to exceed five thousand dollars ($5,000.00). The penalty may be recovered in a civil action and damages shall be assessed by the court. (c) Any action pursuant to this section shall be initiated in Laramie county by the attorney general.
